📜 Terms of Service

1. Acceptance of Terms

By downloading, saving, or messaging the Buddy WhatsApp number ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legal agreement between you and ThemeInnov8 ("we," "our," "us"). We may update these Terms from time to time, and your continued use of Buddy after such changes constitutes acceptance of the updated Terms.

2. Description of Service

Buddy is a WhatsApp-native AI habit coach that enables users to:

• Track personal habits by texting naturally in WhatsApp
• Receive AI-generated confirmations and motivational replies
• Maintain habit streaks with milestone celebrations
• Get personalized nudge reminders when streaks are at risk
• Receive weekly AI-generated habit summaries and insights

3. Service Limitations

Buddy is NOT:

• A medical, therapeutic, or clinical service of any kind
• A licensed counselor, psychologist, or health provider
• A substitute for professional medical advice, diagnosis, or treatment
• Guaranteed to be available without interruption 24/7
• Responsible for the accuracy of AI-generated responses in all cases

If you are experiencing a health emergency or mental health crisis, please contact appropriate emergency services immediately.

4. Eligibility

To use Buddy, you must:

• Be at least 13 years of age
• If under 18, have parental or guardian consent
• Have a valid WhatsApp account in compliance with WhatsApp's own Terms of Service

6. Acceptable Use

You agree NOT to use Buddy to:

• Transmit any unlawful, harmful, threatening, abusive, or defamatory content
• Attempt to gain unauthorized access to our systems or data
• Interfere with or disrupt the integrity or performance of the Service
• Collect or harvest other users' personal information (Buddy is not multi-user)
• Send spam messages to the Buddy WhatsApp number
• Violate any applicable local, national, or international laws or regulations

7. Intellectual Property

7.1 Our Property

The Buddy Service, including its AI prompts, system design, logic, branding, and all associated intellectual property, is owned by ThemeInnov8 and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

7.2 Your Content

When you send messages to Buddy:

• You retain ownership of the content you send
• You grant us a limited license to process your messages to deliver the Service
• Your messages are used solely for habit tracking and AI response generation

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. Key points:

• Your raw phone number is never stored — only a one-way hash
• We do not sell your data
• You can delete all your data at any time by texting "DELETE MY DATA" to Buddy

9. Disclaimers

9.1 "As Is" Service

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free
• AI responses will always be accurate or appropriate
• Defects or errors will always be corrected promptly
• The Service is free of security vulnerabilities

9.2 AI Accuracy

Buddy uses AI to interpret your messages. AI-generated responses may occasionally be inaccurate, misinterpret a message, or fail to track a habit correctly. We are not responsible for outcomes resulting from inaccurate AI responses.

9.3 Habit Outcomes

We are not responsible for your success or failure in achieving any personal goals. Buddy is a tool to assist you — results depend entirely on your own effort and commitment.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amounts you paid us — Buddy is a free service, so our total liability is limited to $0 (zero)
• We are not liable for the actions or omissions of third-party services (WhatsApp, Firebase, Google AI)

11. Indemnification

You agree to indemnify and hold harmless ThemeInnov8, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you transmit through the Service

12. Termination

12.1 By You

You may stop using Buddy at any time. To delete your data, text "DELETE MY DATA" to Buddy or visit our Data Deletion page. Upon termination:

• Buddy will stop sending you nudge messages
• Your habit data will be deleted per our Privacy Policy

12.2 By Us

We may suspend or terminate your access to Buddy if you:

• Violate these Terms
• Engage in abusive behaviour toward the Service
• Attempt to exploit or attack our systems

13. Changes to Service

We reserve the right to:

• Modify or discontinue any feature of Buddy
• Update these Terms at any time
• Introduce or change pricing for premium features (Buddy is currently free)

We will provide reasonable notice of significant changes via WhatsApp message to active users.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.

15. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at theme.innov8@gmail.com. If a dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration under the rules of the Indian Arbitration and Conciliation Act, 1996.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThemeInnov8 regarding the use of Buddy and supersede any prior agreements.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

19. Acknowledgment

By using Buddy, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
